By accessing or using the Tipping Tags platform, mobile application, or related services (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our Service.

2. Description of Service

Tipping Tags is a digital platform that enables individuals to:

• Create profiles and generate QR codes for receiving tips
• Process digital tip payments through our platform
• Track earnings and manage their tipping activity
• Connect with customers who wish to show appreciation for services

3. Eligibility

To use our Service, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information during registration
• Not be prohibited from using the Service under applicable laws
• Comply with all local laws regarding digital payments and income reporting

4. Account Registration and Security

4.1 Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

4.2 Account Verification

We may require identity verification before allowing you to receive tips or access certain features. This may include providing government-issued identification and other documentation.

5. Payment Processing

5.1 Stripe Integration

Payment processing is handled by Stripe, Inc. By using our Service, you also agree to Stripe's Terms of Service and Privacy Policy. We are not responsible for Stripe's services or any issues related to payment processing beyond our control.

5.2 Fees and Pricing

• Starter Plan: 3.1% + $0.40 per tip
• Growing Plan: 2.9% + $0.40 per tip (automatic upgrade at $100+ monthly)
• Pro Plan: 2.7% + $0.40 per tip (automatic upgrade at $1,000+ monthly)
• Fees are subject to change with 30 days' notice
• Premium features may have additional fees as displayed

5.3 Payouts

• Standard payouts are processed according to Stripe's standard schedule
• Instant payouts are available for an additional fee
• You are responsible for providing accurate banking information
• We are not responsible for delays caused by banking institutions

6. User Conduct

6.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

• Use the Service for any illegal activities
• Impersonate another person or entity
• Share false, misleading, or deceptive information
• Harass, abuse, or harm other users
• Attempt to circumvent security measures
• Use automated tools to access the Service without permission
• Interfere with the proper functioning of the Service

6.2 Content Standards

All content you post (including profile information, photos, and descriptions) must:

• Be accurate and not misleading
• Not contain explicit, offensive, or inappropriate material
• Not infringe on intellectual property rights
• Comply with applicable laws and regulations
• Be appropriate for a professional service context

7. Intellectual Property

7.1 Our Rights

The Tipping Tags platform, including all software, designs, text, graphics, and other content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of content you create, but grant us a license to use, display, and distribute it as necessary to provide the Service. You represent that you have the right to grant this license.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting customer support or using the account deletion feature. Upon termination:

• Your access to the Service will be terminated
• Your profile and QR codes will be deactivated
• Pending payouts will be processed according to standard schedules
• Your data will be deleted according to our Privacy Policy

9.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to respond to our requests for information
• Cause harm to our platform or other users

10. Disclaimers and Limitation of Liability

10.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind.

10.2 Limitation of Liability

To the maximum extent permitted by law, Tipping Tags shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

10.3 Maximum Liability

Our total liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Tipping Tags, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or share through the Service

12. Tax Responsibilities

You are solely responsible for:

• Reporting tip income for tax purposes
• Paying all applicable taxes on received tips
• Maintaining records of your tip earnings
• Complying with local tax laws and regulations

We will provide necessary tax documentation (such as Form 1099) as required by law.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to contact us first to attempt to resolve the issue informally.

13.2 Binding Arbitration

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except for small claims court actions.

13.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

14. Governing Law
